TERMS & CONDITIONS

These Terms govern your use of ForgedPerformance.com, the Forged Performance app, and related programs, coaching, training, nutrition resources, challenges, communities, events, and digital content collectively referred to as the “Services.”

By using the website, creating an account, purchasing a Service, or agreeing during checkout, you accept these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to purchase Services. A minor may participate only with the consent and supervision of a parent or legal guardian who agrees to these Terms and any required service agreement or waiver.

The Services are not intended for children under 13.

2. Forged Performance Services

Forged Performance may offer:

• Digital fitness memberships and workout libraries

• Personalized online coaching

• Concierge in-person training

• Group coaching and community challenges

• Nutrition education and accountability

• Progress and performance tracking

• Events, merchandise, and promotional programs

Features, schedules, coaches, content, and availability may vary by package. The description and agreement provided for a specific program are incorporated into these Terms. If there is a conflict, the specific program agreement controls.

3. Fitness and Medical Disclaimer

Forged Performance provides fitness instruction, coaching, and educational information. We do not provide medical diagnosis, medical treatment, physical therapy, mental-health treatment, or other licensed healthcare services.

Consult a qualified healthcare professional before beginning any exercise or nutrition program, particularly if you have an injury, medical condition, pregnancy, recent surgery, take medication, or have been advised to restrict physical activity.

Stop exercising and seek appropriate medical assistance if you experience chest pain, fainting, severe shortness of breath, dizziness, unusual weakness, or sudden or severe pain.

Direct messaging, coaching calls, group chats, and app communications are not emergency services.

4. Nutrition Disclaimer

Meal plans, recipes, macro targets, calorie recommendations, grocery guidance, and nutrition resources are provided for general fitness and educational purposes. They are not medical nutrition therapy or a substitute for advice from a physician or registered dietitian.

You are responsible for reviewing ingredients, allergies, intolerances, medications, dietary restrictions, and portion requirements. Inform your coach of relevant health or dietary concerns.

5. Assumption of Risk

Exercise and athletic activity involve inherent risks, including soreness, strains, falls, equipment accidents, aggravation of existing conditions, serious injury, and death.

You are responsible for using proper form, selecting appropriate resistance and intensity, maintaining a safe exercise environment, following equipment instructions, and disclosing known limitations.

Participation is voluntary. These Terms do not replace any separate informed-consent form, health questionnaire, service contract, or liability waiver required for coaching or in-person training.

6. No Guarantee of Results

Results vary based on effort, consistency, nutrition, recovery, genetics, health, starting condition, and adherence. Testimonials, progress photos, examples, and previous client results do not guarantee that you will achieve the same outcome.

Forged Performance does not guarantee weight loss, muscle gain, improved health, athletic performance, income, competition results, or any result within a particular period.

7. Accounts and Security

You are responsible for maintaining accurate account information and protecting your login credentials. Accounts and memberships are personal and may not be shared, transferred, sold, or used by another person.

Notify Forged Performance promptly if you believe your account or payment information has been accessed without authorization.

8. Purchases and Payment Authorization

Prices, enrollment fees, billing schedules, minimum commitments, and included Services will be displayed during checkout or in the applicable program agreement.

By submitting payment information, you authorize Forged Performance and its payment processors to charge the selected payment method for all disclosed amounts, taxes, and scheduled payments.

You must maintain a valid payment method. Failed payments may result in payment retries, suspension of access, or cancellation, subject to applicable law.

Payments may be processed through Wix, an app provider, or another third-party processor. Those providers may have additional terms and privacy practices.

9. Recurring Memberships

Some memberships automatically renew. Before enrollment, the checkout page will disclose the recurring price, billing frequency, trial terms, and cancellation method.

By completing enrollment, you expressly authorize recurring charges until cancellation. A confirmation of the subscription terms will be provided electronically.

You may cancel an online subscription through the available account or subscription settings, the original purchase platform, or by contacting Forged Performance. Cancel before the next billing date to prevent the next charge.

Deleting the app, closing an app profile, or discontinuing use does not automatically cancel a paid subscription.

10. Fixed-Term Programs

Certain coaching packages require a minimum commitment and are billed through installment payments. These payments represent installments toward the full program price and are not payments for individual appointments.

The program term, total price, number of installments, enrollment fee, and cancellation rights will be disclosed in the applicable agreement.

All payment and cancellation provisions remain subject to nonwaivable rights provided by applicable law.

11. Scheduling and Attendance

Appointments must be scheduled in advance and are subject to coach availability.

Unless otherwise stated, at least 24 hours’ notice is required to cancel or reschedule an appointment. Late cancellations and missed appointments may be forfeited.

Unused appointments generally do not accumulate, roll over, or extend a program beyond its scheduled term unless approved in writing or required by law.

Coaches may reschedule an appointment because of illness, emergency, facility closure, unsafe conditions, or another reasonable circumstance.

12. Cancellations and Refunds

Cancellation and refund rights vary by Service and will be explained during checkout or in the applicable program agreement.

Except where required by law:

• Completed billing periods are nonrefundable.

• Partial-period refunds are not provided.

• Missed appointments and unused digital content are not refundable.

• Enrollment fees are nonrefundable once onboarding begins.

• Event and merchandise purchases may have separate policies.

Verified duplicate charges, unauthorized transactions, and confirmed billing errors will be reviewed individually.

Nothing in these Terms limits any cancellation, refund, disability, relocation, or other consumer right that cannot legally be waived.

13. Community and Group Conduct

Members must communicate respectfully and may not engage in harassment, threats, discrimination, bullying, fraudulent activity, unwanted solicitation, or disruptive conduct.

Private group messages, client information, progress images, and personal disclosures may not be recorded, reposted, or shared without permission.

Forged Performance may remove content or suspend community access to protect members, enforce these Terms, or address unsafe or inappropriate conduct.

14. Member Content

You may submit progress information, meal photos, messages, comments, and other materials through the Services.

You retain ownership of your content. You grant Forged Performance a limited license to store, process, and display that content only as reasonably necessary to provide the Services.

Forged Performance will not use your name, testimonial, likeness, progress images, or before-and-after photographs for public marketing without separate permission.

15. Intellectual Property

The Forged Performance name, logos, branding, workouts, videos, programs, recipes, meal-plan materials, challenges, graphics, written content, and coaching resources are owned by or licensed to Forged Performance.

Your purchase provides a limited, revocable, nonexclusive, nontransferable license for personal use during your authorized access period.

You may not copy, screen-record, reproduce, modify, distribute, publish, sell, sublicense, teach, or commercially exploit Forged Performance content without written permission.

16. Third-Party Services

The Services may integrate with third-party platforms such as payment processors, fitness applications, wearable devices, MyFitnessPal, Fitbit, video-conferencing services, or social platforms.

Forged Performance does not control these third parties and is not responsible for their availability, data practices, content, compatibility, or performance. Your use of third-party services is subject to their terms.

17. Website and App Availability

We aim to provide reliable access but do not guarantee uninterrupted or error-free operation. Access may be affected by maintenance, updates, internet outages, device compatibility, payment platforms, app providers, or circumstances beyond our reasonable control.

We may update, replace, or remove content and features while maintaining the general value of the purchased Service.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the website, app, content, and Services are provided “as is” and “as available.”

Forged Performance disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement, except where such disclaimers are prohibited by law.

19. Limitation of Liability

To the fullest extent permitted by law, Forged Performance will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from your use of or inability to use the Services.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability resulting from fraud, willful misconduct, or other conduct for which limitation is prohibited.

20. Suspension or Termination

Forged Performance may suspend or terminate access for fraud, payment default, threats, harassment, unsafe behavior, account sharing, intellectual-property violations, misuse of community features, or material violation of these Terms.

Termination for misconduct does not eliminate valid payment obligations, subject to applicable law.

21. Privacy

Use of the Services is also governed by the Forged Performance Privacy Policy. Health, progress, nutrition, account, and payment-related information will be handled as described in that policy and the policies of applicable third-party providers.

22. Electronic Communications

You consent to receiving transactional emails, receipts, account notices, billing communications, onboarding information, and service updates electronically.

Marketing messages will be sent only where permitted and may be unsubscribed from through the method provided in the message.

23. Changes to These Terms

Forged Performance may update these Terms to reflect changes in Services, business practices, or legal requirements. The updated effective date will appear at the top.

Material changes affecting an existing paid plan will be communicated as required by law. Continued use after an update constitutes acceptance of the revised Terms.

24. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Subject to any nonwaivable consumer rights, disputes relating to these Terms or the Services will be handled by courts with appropriate jurisdiction in Ventura County, California.

25. General Provisions

If any provision is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

Failure to enforce a provision is not a waiver of that provision. You may not transfer your rights under these Terms without written permission.

These Terms, the Privacy Policy, checkout disclosures, and any applicable program agreement form the complete agreement concerning the Services.
